Federal Judge Mandates Release of Abrego Garcia from Immigration Detention
A court has ruled the immediate release of Kilmar Abrego Garcia from detention by ICE, finding his continued detainment is without lawful basis.
"Since his release after erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," the judge wrote in her order.
The situation originates in a mistaken deportation to El Salvador in March, which US authorities later acknowledged was an error. After his repatriation to the United States to face alien smuggling charges, he was detained in immigration custody.
In her order, the court pointed out that the authorities does not have a current deportation order, which prevents them from deporting Mr. Abrego Garcia "at this time."
